i am running statspack and i see
rollback per transaction % 98,95
and user rollbacks 44055 5.7 1.0

how can i fix it? is a database problem or an aplication problem?

Ask your application (surely one ported from a Sybase or SQL Server one) to no more rollback for nothing.

michael, i don't understand you what do you mean with "ask your aplication"?
the app is a 3rd company app from a private developer (not sybase or sqlserver)

If you can't change the code, then you have to live with your rollback.

The important to see is if statistics "rollback changes - undo records applied" is high or not. This will show you if it is real rollbacks or empty ones.
